Following the directives from the panchayat director, Bardez block development officer has directed all village panchayat in the taluka to implement Construction and Demolition Waste Management Rules, 2016, and ensure that no construction debris is dumped in an open place.

The government has notified two places for dumping of the debris in Bardez from Green Park to Karaswada and from Green Park to Guirim junction.

The BDOs have issued memorandum to all 33 panchayat secretaries in the taluka to ensure that no construction debris is dumped in their panchayat jurisdiction in the open.

The panchayat secretaries are directed to implement Construction and Demolition Waste Management Rules, 2016 as a whole, and more specifically sections 4 and 6 wherein the panchayat secretary has been asked to obtain an affidavit from waste generators with regard to the disposal plan of the construction debris at his own level. In case there is no plan then the waste generators will have to contact the PWD and dump the debris at the notified places.

The panchayat has been asked to ensure that no debris is dumped at any other place other than the designated places with permission from the PWD.

All panchayats are directed to incorporate pre- laid conditions while granting construction licences like -debris should be dispose at own level or at notified sites at own expense; applicant should produce the certificate issued by the concern PWD official of notified site. If the applicant fails to comply then a penalty shall be imposed to applicant at a rate of 0.5 per cent on the total cost of the project and also construction licence issued to the applicant shall be withdrawn.

The panchayat bodies are also provided with contact details of PWD officials for the designated site so that applicant can be assisted by the local body.

The panchayats have been asked to ensure that the work of disposing the construction debris is done in approved manner failing which action ‘shall be taken against the village panchayat.’

The memorandum has been issued in view of the order dated March 7, 2018 of the High Court of Bombay at Goa. The block development officer I for Bardez Krishnakant Pangam informed that “we have issued instructions to all panchayat secretaries with regard to disposal of construction debris.

“Government has notified designated places for dumping of construction debris and panchayat has to incorporate condition in construction licence also and panchayat has to ensure prior to issue of occupancy certificate that applicant has fulfilled the condition in regards with disposal of debris “added Pangam.

He further added that “two notified sites in Bardez are from Green Park to Karaswada and Green Park to Guirim junction where debris dumping can be done with prior intimation to PWD official.”
